LAWYER’S NOTES -18th century

Jane Culmer by her indenture dated 3rd December 1718 covenants to stand seized of and in a certain messuage or tenement in Watling Street, in the parish of St Margaret, in the City of Canterbury, to the use and behoof of the said Jane her heirs and assigns for her life, and after her decease to the use of Susan Culmer (her daughter) and the heirs of her body, and for default of such issue to the right heirs of the said Jane forever… Jane the mother dies and after her decease Susan the daughter mortgages the premises to Richard Edwards for payment of money… now conceive that such mortgage (there being a fine levied to confirm the same) will remain in force no longer than for the life of the said Susan. But that the said Richard Edwards may at any time during her life compell her to levy a fine for the said premises to confirm the same mortgage.

CANTERBURY - 1815

Letter addressed 'to the Churchwardens of St Mary Bredman in Canterbury'.

Gentlemen,
In compliance with your wish I wrote to the Revd The Minister of Strood - enquiring into the plans of rebuilding their Church - and I here enclose his answer. I have to observe that we seem to have occasion merely to notice that part of it - which adverts to the £1000 collected from contributions only made in their Neighbourhood - from whence I am sanguine enough to hope that if a thousand pounds could be so obtained round an immediate Neighbourhood, we may look for success from the circular Letter which I shall beg to propose to be sent to every Minister in the County, if the Committee approve.
I hope the parish will enter cordially into this measure - They have my anxious good wishes, and I shall join their Endeavours to the best of my Power. I am Gentlemen, yr friend and servant,

CERTIFICATE OF RESIDENCE

To the Churchwardens and o'seers of the poor of the parish of St Mary Breadman in the City of Canterbury.

Wee whose Names are here unto subscribed, Churchwardens and Overseers of the poor of Holycross Westgate within the walls of the aforesaid city in persuance of an Act of Parliament made in 8 and 9 year of our late Sovereign King William the 3rd entitled 'An Act for the better settling of the poor in every parish in the Kingdom' hereby certifie that Christopher Soames his wife and family are inhabitants legally settled in our said parish of Wholy Cross Westgate aforesaid and in case he the said Christopher Soames his wife and family shall and may at any time hereafter become chargeable to your said parish of St Mary Breadman in the City of Canterbury aforesaid by asking Alms or desiring relief that then we will reserve them into our said parish of Wholy Cross and provide for them accoring to lawe, In witness whereof we have here unto sett our hands and seales the 1st(?) day of August 1716.

LEASE

Indenture dated 3rd May 1680 between Francis French of Birchett in the parish of Seale in the county of Kent, Gentleman of the one part and William Wakelyn of the parish of Chelsfield in the county of Kent, yeoman of the other part... WITNESSETH that for and in consideration of the rents and covenants hereinafter mentioned Francis French... HATH demised, granted and to farm let to William Wakelyn... ALL that messuage or tenement wherein the said William Wakelyn now dwelleth, containing by estimation 16 acres, all which said premises are situated in the parish of Chelsfield ( excepting rights to timber )... TO HAVE AND TO HOLD unto the said William Wakelyn from the feast day of St Michael the Archangel last past next before (sic) the date of these presents for the term of 21 years... YIELDING AND PAYING therefore to Francis French att his dwelling house as follows.. on the feast day of the annunciation of the blessed Virgin Mary and St. Michael the Archangel in equal portions the sum of £14 yearly, as long as his dwelling house be not more than 30 miles distant from Chelsfield... if payment more than 21 days late after the feast days then premises can be repossessed.

DEED TO LEAD TO THE USES OF A FINE

Indenture dated 3rd March 1733 BETWEEN John Pawson of the city of Canterbury, barber and perriwigmaker, and Luke Pawson of the said city, carpenter (which said John and Luke Pawson are the sons and heirs of Luke Pawson, late of Ashford, joiner, deceased, and Mary his wife, also deceased) of the one part, and Mathew Browning of the said city of Canterbury, carpenter, of the other part... WITNESSETH that for the barring of estates tail of and in the messuages etc hereinafter mentioned…. it is covenanted that the said John and Luke shall and will within six months…. acknowledge and levy unto the said Mathew Browning a fine etc… to those 2 messuages under one roof or covert and formerly were but one house… and of all the stables, edificies, outhouses etc…. and also of all that 1 acre of land, formerly pasture, but now converted to a garden or gardens… situated in the town of Faversham in a street there called West Street…. and whereof one of the said messuages is now in the possession or occupation of William Stronts…. and the other of ----------- (sic) one moiety to the use and behoof of John Pawson, the other to the use and behoof of Luke Pawson….

GOUDHURST - 1472

MORTGAGE

Lease between John Walker, chaplain, vicar of the church of Boughton Monchelsey, Stephen Wayte of Goudhurst and Henry Burgeys of the same place, in the form of a deed of gift indented to Thomas Mughe of three pieces of arable land adjoining together and situated in the parish of Goudhurst upon the denne of Pykendenen called Crouredys and containing by estimation 12 acres of land... TO HAVE AND TO HOLD unto the said Thomas Mughe his heirs and assigns of the chief Lords of that fee by services there accustomed to be rendered... under the condition following, that if the said Thomas Mughe or others in his name pay or cause to be paid unto the said John Walker, Stephen Wayte and Henry Burgeys... in the parish church of Goudherst £20, ie £6/6/8 on the feast day of St Michael the Archangel, which will be in 1473, £6/13/4 on the feast day of St Michael the Archangel next ensuing... in full payment of the said £20, then the said three pieces of land will remain to the said Thomas Mughe his heirs and assigns forever... but if it happens that the said Thomas shall not pay the sum aforesaid, then the said three pieces of land shall remain to the said John Walker et al forever.

Quitclaim by Thomas Frencheye of the parish of Wodecherche to James Hope and Henry Hope, sons and heirs of Stephen Hope of the parish of Halden of 2 pieces of land lying together in the parish of Halden above the den of Henuerisden (?), abutting to the north to lands of William Amyot and south to lands of Elene, widow of William Monynden and east to lands of Thomas Sextayn and west to a certain road called le gorestrete.

DEED TO LEAD TO THE USES OF A FINE

Indenture Quinquepartite dated 4th February 1680 made between Robert Jacob of Hawking in the county of Kent, yeoman, and Mary his wife of the first part, Thomas Rigden of Lyminge in the county of Kent, yeoman, and Mary his wife of the second part, John Barham of Cheriton in the county of Kent, clerk, of the third part, Richard Hogben the younger of Lyminge, weaver, of the fourth part and Joseph Hobday of Wotton in the county of Kent, miller of the fifth part…. WITNESSETH that the parties of the first two parts do covenant, promise and grant to Joseph Hobday his heirs and assigns that they will before the end of Easter Term next… levy a fine…. of all that messuage or tenement, together with the barn, stable, garden, orchard….situated in Hawking and now in the tenure or occupation of Robert Jacob… which said messuage etc was lately purchased of Robert Jacob by John Barham….

HERNE - 1386

FEOFMENT

Feofment by Thomas Herry, chaplain, licensed by a charter of Lord Richard the second, King of England, to the prior and convent of Christ Church Canterbury of one wind mill with the appurtenances in Herne.. TO HAVE AND TO HOLD to the same prior and convent and their successors in perpetuity, to the value of 8s... in part in satisfaction of lands and rents to the value of £20 per annum, which Lord Edward, late King of England by his letters patent gave to the prior and convent in augmentation of the endowment of a certain alter of the blessed virgin Mary in the church aforesaid next the ordina nonem of the said prior and chapter.

Dated at Canterbury 12th January 1386.

Attached to the document is a seal tag bearing a seal, in dark red, with an indistinct impression.

Feofment by Thomas Forde of Horsmonden to Nicholas Ryche of Otteham of two pieces of land with one garden and its appurtenances, lying divided in the parish of Merden upon the denne of Rede, of which one piece of land with the garden lies between the lands of the heirs of John Pympe towards the South and West, to lands of the heirs of John Topelys and lands of the heirs of Thomas Yppyngbery towards the East and to lands of the heirs of John Pympe towards the North... the other piece of land is called Messeyesbroke and lies to a certain communal lane there towards the East, to a road there towards the North... he also granted to the said Nicholas one annual rent of 3s 4d forever, to be paid on the feast day of St Michael the Archangel and on Easter by equal payments, arising out of one garden and two pieces of land lying divided in the parish of Huntyngton in the county of Kent, of which the said garden lies towards the King’s highway there towards the North, to a garden late of Margery Grocer towards the West and South, and to lands of the heirs of Gilbert Jacob towards the East, one of the pieces of land aforesaid is called le Yerd and lies between the King’s highway towards the East and West, to lands late of John Snode towards the North, and lands of John Hunt towards the South... the other piece of land is called Carterrshawe and lies between the King’s highway there West, a lane called loverodeslane towards the North, and lands of William Ryche towards the South and East, with power to distrain for non-payment of the annual rent, as in a charter indented made between the said Thomas Forde and John Broman of Huntyngton, made at Huntyngton 26th August 11 Edward 4... he also gave to the said Nicholas one annual rent of a cock on the feast of the nativity of our Lord and 14d payable on the feast of Easter and St Michael the Archangel in equal payments, arising out of a messuage and one garden lying together in the parish of Huntyngton, between the King’s highway leading from Huntyngford (sic) towards the East, lands called Scottes towards the North and West and lands of John Joose towards the South, with power to distrain for non-payment of the annual rent, as appears by charter indented made between the said Thomas Ford and John Joose... TO HAVE AND TO HOLD the afore granted lands etc... to the said Nicholas Ryche his heirs and assigns forever... of the chief Lords of the fee.

LOOSE - 1536

GRANT

Grant by Henry Malym, weaver, of Staplehurst, for 20 marks to John Taillour of West Malling in the county of Kent, yeoman of a garden and two pieces of land in Loose, of which the garden and one piece of land called Sybolles lie between a pedestrian path east, the King’s highway called Sharnolstrete south and west and land lately of Thomas Denly, gentleman, north… the other piece of land called Southfeld lies between the land of Thomas Fisher east, of the prior and convent of Christchurch Canterbury south, and of the grantor Henry Malym west and north and also the aforesaid King’s highway north.

Dated 26th March 1536.

LEASE FOR ONE YEAR

Made 22nd April 1807 BETWEEN Stephen Austen Cumberledge of Sunbury, in the county of Middlesex, Esquire, of the one part and William Rigden of the city of Canterbury, Gentleman, of the other part……. WITNESSETH that for consideration of 5/- … Stephen Austen Cumberledge HATH bargained and sold to Willaim Rigden... ALL that messuage situated at Etchinghill in the parish of Lyminge …. and also all that piece or parcel of meadow land called Stone Meadow, containing 4 acres,.. and also all that piece or parcel of land called Bullinge, containing 6 acres 3 roods and 24 perches… and also all that piece or parcel of land called Old Stye, containing 4 acres… and also all those two pieces or parcels of land called Upper Leazes and Lower Leazes, containing 5 acres, 1 rood and 16 perches and 5 acres, 19 perches, which last two are situated in Dover Lane in Lyminge, and also all that piece of land in Lyminge called Sheep Hanger, containing 2 acres, 1 rood and and 21 perches, , bounded on the north, east and west side thereof by the land of Mr William Jacobs and on the south by the land of the Archbishop of Canterbury….etc

Indenture dated 8th March 1700 between John Solly of the town and port of Sandwich, mercer, and Martha his wife, William Catland of Sarre in the Isle of Thanet, yeoman, and Katherine his wife, Peter Stevens of the parish of Mister in the Isle of Thanet, yeoman, and Elizabeth his wife and Robert Brett of the parish of Eythorne, yeoman, and Frances his wife of the one par, and Robert Kennett of Minster, yeoman, Edmund Andrews of the parish of Staple, yeoman, and Edward Morris of the parish of Walmer, yeoman, and Stephen Solly of Sandwich, malster, of the other part… WHEREAS the said by indenture of Lease and Release HAVE bargained and absolutely conveyed unto the said Peter Stevens his heirs and assigns forever... ALL that messuage or tenement together with the barns, yards, backsides etc thereunto belonging containing by estimation 5 acres, lying and being in the parish of Minster, heretofore in the tenure or occupation of Henry Terry… and now or late in the tenure or occupation of the said Peter Stevens… AND all that piece or parcel of land thereunto belonging called or known by the name of Little Howfield, lying in the parish of Minster, containing by estimation 20 acres of land… now or late in the tenure or occupation of Henry Terry, and now or late also in the tenure or occupation of Peter Stevens… AND WHEREAS, the said William Catland by indenture of lease and release absolutely conveyed to the said Robert Kennett two messuages… together with approximately 2 acres of land…. in the parish of Minster, and now or late in the tenure or occupation of Austen Johncock and the said William Catland….AND whereas the said Peter Stevens by indentures of Lease and Release absolutely conveyed to the said John Solly... ALL that messuage or tenement with approximately 3 acres of land situated in Ash next Sandwich… at or near a certain place there called or known by the name of Ashstreet, and now or late in the tenure or occupation of John Bing…. AND whereas also the said Peter Stevens HATH bargained sold and absolutely conveyed unto the said Edmund Andrews… ALL THAT messuage or tenement and land, containing by estimation 4 acres situated in the parish of Staple at or near a place there called Shatterling, and now or late in the tenure or occupation of Thomas Constant… AND ALSO all those two pieces of pasture land ( heretofore in three pieces ) containing 3 acres situated in the parish of Staple at ior near the aforesaid place called Shatterling, and now or late also in the tenure or occupation of the said Thomas Constant…. AND WHEREAS also the said Robert Brett… HATH bargained and absolutely conveyed unto the said Edward Morris… ALL those 2 pieces of fresh marsh land containing 5 acres situated in the parish of Sholden, and now or late in the tenure or occupation of the said Robert Brett…. NOW THIS INDENTURE WITNESSETH that for the more perfect way of ensurng title etc…. a fine be levied…

Grant by Joan Jacob of Nettlestead, in the county of Kent, widow, sister and heir of William Morrell, late of Yalding in the county of Kent, now deceased, son and heir of Richard Morrell, late of Yalding, now also deceased for certain sum of money to William Lytyll of a garden and two pieces of land in the parish of Yalding, of which the garden and one pieces of land there are called Cromys, and the second piece of land is called Comrogers (?) Croft, which were late of the said Willaim Morrell and which the said Joan inherited after the death of the said William Morrell her brother.

Feofment by Robert Toke of Ashe in the county of Kent gentleman to Henry Harte yeoman, Richard Deringe, gentleman, Henry Idiall, yeoman, Anthony Hunt and George Kingsnothe of one messuage, one garden and pieces of land of which one is called Culverton and another is called Raynard’s Croft, lying and being together at Pluckley Hill in the parish of Pluckley…. to the King’s highway there towards the west and north, to lands of John Betynham, gentleman, and to lands of the said Robert Toke towards the east, and to the cemetery of Pluckley and to a forstal there towards the south, containing by estimation 10 acres…. TO HAVE AND TO HOLD…unto the said Henry Haute et al to the use of the said Henry Haute and his heirs forever… in exchange for 5 pieces of land called Barlinge, Longreche, Schyplands, Hyefeld and Reyham as more plainly may appear by the charter from Robert Toke to Henry Haute.

Quitclaim by Henry Haute of Owlcum, in the county of Kent, clothier, one of the sons of John Haute, late of Pluckley, yeoman, in consideration of £20 to Anthony Deeringe of Pluckley and his heirs… of and in one messuage, barn, one orchard, one garden, and two pieces of arable land , meadow and pasture called Culverton and Raynardes Crofte, lying in Pluckley,which were late of John Haute his father.

Dated 15th June 1587.

SANDWICH - 1532

GRANT

Grant by Robert Manfelde of the town of Sandwich, saddler, to Thomas Alcock of the same town, gentleman, of 3 tenements and 2 gardens now lying and being in the parish of St Mary the Virgin, bounded by a lane called Sereleslane to the West, the lane called Geldcontlane to the North, a tenement of John Gastist (?) and a garden of the said Thomas to the East, and a tenement of William Parye to the South…. on condition that the said Thomas Alcock pay Robert £5 on 29th September next and another £5 on 24th June following; if part or all of these payments are unpaid within 8 days after date due, Robert can re-enter and repossess the property.

Dated at Sandwich 1st July 1532.

Grant by Richard Butlare of Sandwich, jurate, son and heir of John Butlare, while he lived, one of the jurates there, to Edward Ryngelye (?) of the same place, knight, all that empty piece of land formerly a stable or barn with its appurtenances situate and being in the parish of St Mary the Virgin in the town aforesaid, in a lane there called Paynts Lane towards the West, a tenement called le Castill Fflynt, and a stable formerly of John Langlay, esquire, in the said Edward Ryngelye, knight, towards north, and another piece of land formerly of the said Edward Ryngelye there towards the East and South… to have and to hold unto the said Edward Ryngelye forever.

SHELDWICH - 1739

ASSIGNMENT OF MORTGAGE

Indenture Tripartite made 13th July 1739 between Vincent Williams of Faversham, barber and perukemaker (one of the executors of the last will and testament of Charles Dodd, late of Selling, blacksmith, deceased) of the first part, William Smart of Gillingham, yeoman, of the second part and Ann Dodd of Selling (one of the daughters of the said Charles Dodd) of the third part.. WHEREAS by indenture dated 6th November 1730 between William Smart of the first part and Vincent Williams of the other part, in consideration of £80 (being the proper monies of William and the said Ann Dodd, then infant son and daughter of Charles Dodd) did grant, bargain and to farm let ALL their messuage, tenement or cottage and shop and orchard thereto belonging, containing by estimation 2 acres, in the parish of Leveland, theretofore in the tenure of William Sankey, since of Edward Staples and then in the tenure or occupation of William Smart…AND also several pieces of land arable in one piece commonly called Forefield, containing by estimation 10 acres, situated in Sheldwich, then or late in the tenure or occupation of Thomas Coles, the elder, and then of the said William Smart.. TO HAVE AND TO HOLD.. subject to a proviso for redemption... NOW THIS INDENTURE WITNESSETH that for £80 consideration paid by Ann Dodd to Vincent Williams, and 5/- to William Smart... they discharge and exonerate the said Ann Dodd… and the said Vincent Williams HATH assigned and set over unto the said Ann Dodd the premises etc.. TO HAVE AND TO HOLD unto the said Ann Dodd for the residue of the term of 500 years, subject to a priviso for redemption..

Attached to the seal fold is a seal, c 1 ½ cms dia, in red wax, slightly ovate, bearing the impression of a griffin rampant within a bordure.

Grant by Lawrence Fowle of the parish of Smarden to Edward Norton, gentleman, Edward Pell, Lawrence Marler and Nicholas Webbe of the same place, of all those lands and tenements which he had on the day he made the charter, lying and being in Smarden, upon the dennes of Brnesnothe, Capynden and Odynham, or elsewhere in the said county of Kent… TO HAVE AND TO HOLD unto the said Edward Pell et al…. and their assigns, to the use of the said Lawrence Fowle his heirs and assigns forever.

YALDING - 1550

GRANT

Grant by Margaret Kenworth, widow, of Yalding, to her son Robert Kenworth of two parcels of land, containing 18 acres by estimation, in Yalding, which lands were formerly of John Arkynbold, deceased, and which Margaret had acquired from her son Richard. She appoints George Fyner and John Gartford, son of James Gartford, her attornies to deliver seisin.

Dated 31st May 1550.

YALDING - 1556

BOND

Bond by Richard Brown of Yalding, glover, to William Turnour, of the same place, tailor, in £8 to be paid at Easter next.

The condition of the bond is such that if Richard Brown and Marion his wife fulfill all their obligations contained in a pair of indentures of the same date between them and William Turnour, then the bond is void.

Dated 22nd March 1556.

The witnesses are Richard Penfold, Christopher Herenden (?) and Stephen Astyn.
